Terms and Conditions of Travel

The purchase of any travel services offered on this website or thru the call center constitutes a contractual agreement between you and Florida Sunshine Shuttle. (“Florida Sunshine Shuttle” or the “Company”), and represents your acceptance of these terms and conditions set out herein (the “Terms and Conditions”). Please ensure that you read carefully and understand these Terms and Conditions prior to booking. These Terms and Conditions are subject to change at any time without notice.

It is the responsibility of each customer to protect their travel investment with the proper travel insurance. Refunds, credits, or waiver of fees will not be issued regardless of reason or issue. Please contact us to purchase travel insurance or contact your Travel Agent.

1. Baggage Policy

All vehicles are equipped to carry one piece of luggage per person and one carry on’s per person. If you have more bags please call us in advance to let us know. We reserve the right to charge an additional fee.

The maximum allowable weight of your luggage per piece is 50 lbs. You must be able to carry your own luggage – if it is too heavy for you it is too heavy for our drivers and they will not carry it.

All carry ons must be able to fit in the overhead compartment or under the seat in  front of you. For safety, bags are not permitted in the isle at any time.

The Florida Sunshine Shuttle reserves the right to refuse any carry-on or checked luggage for security purposes.

Luggage Identification Tags

Luggage Identification Tags are required on each piece of checked luggage. Regulations require that each piece of baggage have an identification tag attached to it, which must include the owner’s home address and telephone number.

Prohibited Items

Prohibited items include acids, ammunition, animals, combustible liquids, compressed gases, corpses, cremated remains, explosives, firearms of all types, fireworks, flammable liquids, furniture, hazardous materials (poisons, radioactive materials, etc.), materials with a disagreeable odors are strictly prohibited to be checked in or brought on-board.

Oversize Items

A bicycle can be considered as one (1) piece of allowable luggage. Bicycles will be transported when disassembled and contained in wood, leather, canvas or other carrying case that does not exceed 8″ x 32″ x 60″ and which is securely fastened. There is a $25 – $75 fee assessed for excess, oversize or overweight items as defined in the section above.

Skis are considered as one (1) piece of allowable luggage and must be bagged or boxed securely.

1a. Private Shuttles
All vehicles are equipped to carry two pieces of luggage per person and one carry on. If you have more bags please call us in advance to let us know. We reserve the right to charge an additional fee.

Florida sunshine shuttle assumes no responsibility for any loss or damage to  personal property on any of our transportation shuttles.

2. Check-in Procedures

Scheduled Shuttles/Shared Shuttles
Passenger check-in is available 15 minutes prior to scheduled departure in most cases. The Florida Sunshine Shuttle recommends passengers arrive at the departure station location at least 15-30 minutes prior to their scheduled departure. Passengers presenting themselves on-board without a reservation will not be permitted to travel. Advance Reservations are required!

Passengers not at the designated collection point at the agreed time and who have not contacted us will be considered a no show. No refunds will be given.

3. Conditions Of Carriage

Right To Refuse Transportation
We reserve the right to refuse transportation to anyone deemed unsafe or unsuitable for travel. Passengers whom are denied boarding will not receive any type of refund or compensation. Passengers who intimidate, threaten or interfere with any employee or fellow passenger will be denied boarding. Raised vocal tones are deemed intolerant and will be dealt with accordingly. Please be considerate of fellow passengers. Customers whom are denied boarding will no longer be able to travel with us for future trips.

3a. Scheduled/Shared Shuttles
The Florida Sunshine Shuttle wishes everyone a pleasant journey when they travel with us. However, it is necessary for all of our passengers to maintain an acceptable level of conduct when traveling. Your email confirmation is not required to board shuttle as you are listed on the driver manifest.

1. Valid Government Issued Identification is required to board all The Florida Sunshine Shuttle Motor coaches.
2. Reservations made on-line require a Major Credit Card.
3. Fares quoted are valid on Florida Sunshine Shuttle and are quoted in United States Dollars.
4.Payment is due at the time of booking.
5. Fare quotes do include a 5% Fuel Surcharge unless otherwise noted.
6. Advance Reservations are required.
7. Tickets are good for the date of purchased travel only unless otherwise specified.
8. Schedules and Fares are subject to change without prior notice.
9. No discounted fares may be combined with other special offers or discounts unless otherwise noted.
10.Passengers agree to hold Florida Sunshine Shuttle harmless for any actions by others.
11.No Show Reservations are not eligible for a refund.
12.Departure date and time may not changed.
13.The Florida Sunshine Shuttle will not be responsible for delays caused by breakdowns, road conditions, weather, or other conditions beyond our control. All Scheduled Service and Shared Shuttle times are approximate.
14.The Florida Sunshine Shuttle will not be responsible for lost or stolen tickets.
15.The Florida Sunshine Shuttle reserves the right to refuse passage to any passenger that may cause disruption on-board.
16.The Florida Sunshine Shuttle does not allow passengers to consume alcoholic beverages while on-board.
17.Carriage of weapons, explosives, or any other type of harmful substance is strictly prohibited.
18. Oxygen Tanks are strictly prohibited on-board any shared/scheduled vehicle.
19. Customers are responsible for any damage that occurs as a result of negligence.
20. The bus line operators reserves the right to substitute equipment based on operational needs. (Florida Sunshine Shuttle does not operate, maintain or the control the bus lines)
21. The Florida Sunshine Shuttle is not responsible for any loss you may incur other than the amount of monies paid to us.

Reserving one trip and showing up for another trip you will be charged the difference (if any) in price for full phone fare plus an additional $30.00 processing fee.

3b. Private/Charter Shuttles

1. Reservations made on-line require a Major Credit Card.
2. Fares quoted are valid at the time given on Florida Sunshine Shuttle and are quoted in United States Dollars.
3.Payment is due at the time of booking. Fares subject to change without notice at any time.
4. Fare quotes do include a fuel charge, airport/seaport fees and drivers gratuity unless otherwise noted.
5. Advance Reservations are required.
6. No discounted fares may be combined with other special offers or discounts unless otherwise noted.
7.No Show Reservations are not eligible for a refund.
8.The Florida Sunshine Shuttle will not be responsible for delays caused by breakdowns, road conditions, weather, or other conditions beyond our control
9.The Florida Sunshine Shuttle reserves the right to refuse passage to any passenger that may cause disruption on-board.
10.The Florida Sunshine Shuttle does not allow passengers to consume alcoholic beverages while on-board.
11.Carriage of weapons, explosives, or any other type of harmful substance is strictly prohibited.
12. Oxygen Tanks may only be transported on private shuttles.
13. Customers are responsible for any damage that occurs as a result of negligence.
14. The Florida Sunshine Shuttle reserves the right to substitute equipment based on operational needs.
15. The Florida Sunshine Shuttle reserves the right to refuse service to anyone deemed to be a threat to safety.
16. The Florida Sunshine Shuttle is not responsible for late arriving flights or port delays. It remains your responsibility to notify the office of flight delays. If you wish for the driver to wait,  Wait time for the first 30 minutes after scheduled departure time is complimentary. Each 30 minutes thereafter is charged at a rate of $75.00 incrementally for sedans and vans and $125.00 for minibuses and motor coaches.
17. A $50.00 meet & greet will be added to all reservations that do not have or provide a cell phone contact number. This charge is non refundable once billed for any reason.
18. We reserve the right to substitute your transportation whether that be private or shared based upon operational needs. No refund on discount will be given regardless of original reservation as transportation has been provided.

3c. The Florida Sunshine Shuttle reserves the right to charge an additional fee of $10.00 or 10% whichever is greater on all reservations made within 5 days of travel whether those be transfers be private or shared. A $30.00 or 10% whichever is greater additional priority fee applies to all private reservations made within 24 hours of travel.

3d. We are not responsible for any lost or stolen items or any items left on vehicles both private and shared. Passengers agree to hold Florida Sunshine Shuttle harmless for any action by others.

3e. On all shuttles and transfers whether they be private or shared you are paying for transportation only. Anything above the transportation is considered an extra and amenity. Extras and amenities are exactly that, extra and are not to be considered as a guarantee included with payment. Extras include but are not limited to; audio visual equipment, entertainment of any kind, internet access, food or beverage, lavatory facilities, bus attendant, any type of conversation or electrical outlets for your electronic devices.

3f. The Florida Sunshine Shuttle nor any of its successors, agents or third party operators guarantees implied or otherwise any exact pick up time or time of arrival on any of its shuttles whether it be private or shared. Regular business hours are 8:00 AM until 9:00 PM. You are subject to late night and/or early morning pickup fees if a driver is on the road outside these hours.

3g. Anyone disembarking the ship early and refusing to wait their turn for pickup and taking alternate transportation will not receive a refund of any kind. Drivers are not just waiting at the port for parties to disembark, everyone has an estimated pickup time. Drivers report to work at 8:00 AM If you disembark early you will have to wait.

All drivers employed by the Florida Sunshine Shuttle are subject to a criminal background check and safe drivers check.

5. Vehicles / Equipment

The Florida Sunshine Shuttle will at times act as a booking agent for contracted services. When booking you agree to hold us harmless for actions by others and our sole liability is limited to a refund of monies paid to us. You are also bound by all conditions of carriage on contracted vehicles as you are on vehicles owned by The Florida Sunshine Shuttle.

We reserve the right to substitute vehicles/equipment for operational purposes at any time and at no time is there a guarantee of a certain vehicle/equipment type.

6. Driver Gratuity

All Florida Sunshine Shuttle private transfer trips have 10% Driver Gratuity built in to the fare unless otherwise noted . If you find your driver extraordinary, you are welcome to give the driver an additional tip. Standard tipping is 20% for any venue of service.

7. Identification

All passengers using Scheduled or Shared Shuttles are required to present a valid government-issued photo ID (e.g. driver’s license or passport) on-board. If you are traveling using one of our discounted fares, additional identification may be required to prove eligibility.

8. Infants 

Infants under 2 years of age not occupying a seat on scheduled/shared shuttles may be held in the lap, free of charge with a fare paying passenger on select transfers. One (1) infant per paying passenger. Children over the age of 2 years must pay for an individual seat at the regular fare. All children regardless of age must be counted on private shuttles.

9. Payments 

The Florida Sunshine Shuttle accepts Cash* (on select transfers) Visa, MasterCard and Discover. We do NOT accept American Express! Unless otherwise specified all scheduled service and shared shuttles pricing is each way and per person. Private service is priced per group unless otherwise noted.

10. Privacy Policy

At the Florida Sunshine Shuttle, we are concerned about your privacy, and take steps to safeguard the information you submit to us, whether over the Internet, by telephone, or by other means. We do not share information about you with any third party unless it becomes necessary in the course of doing business. If you have further questions concerning the policy or the safety of your personal information, please contact us. Your information can be shared with other associations, businesses or government agencies as deemed necessary.

Only the confirmed passenger may make changes to a reservation regardless of the amount of people traveling.

We do not ever release information as to who is or how many passengers are on a particular shuttle.

10a. At no time will any employee discuss a reservation with anyone except the customer of record, including with anyone who claims to be a “family member”. The Florida Sunshine Shuttle does not and will not disclose or discuss any reservation except with the customer of record or if placed with a travel agent their agent of record. Customers whose travel was reserved through or paid for by a travel agent must have their travel agent contact to make any changes. Changes may be made to a reservation by telephone by calling from the number that is on their reservation or by email from the email address on their confirmation only. The Florida Sunshine Shuttle will not verify any customers reservation except with the party of record.

11. Refund Policy

11a. Scheduled/Shared Shuttles
All scheduled service and shared shuttle with the Florida Sunshine Shuttle are non-refundable for any reason once reservation is placed.

If you miss your scheduled trip departure time, Florida Sunshine Shuttle assumes no liability and a refund will not be issued.

11b. Private Service
If canceling your reservation within 3 days of first departure no refund will be issued. A cancellation fee may be applicable if canceling your reservation outside of 3 Days. Cancellation fee is determined by a number of factors including but not limited to date, amount of passengers, total amount of reservation and type of vehicle. A minimum cancellation fee of $35.00 or 10% (ten percent) whichever is greater applies to all private service reservations.

11c. Holiday Refund Policy: All Reservations scheduled to depart between December 22nd and January 2nd are NON-REFUNDABLE once placed for any reason. If you have scheduled a pickup between these dates your reservation is NON-REFUNDABLE for any reason including but not limited to: weather delays, missed flights, trip cancelation or any other type of incidence.

11d. Minibus/Motorcoach/Charter
Charters are subject to a cancellation fee policy as follows: Cancellation of trip up to 90 days from departure a $50.00 or 10% fee applies. Cancellation of trip 90 days from departure is charged a cancellation fee of 25% of total charter, Cancellation of trip 60 days from departure is charged a cancellation fee of 40% of total charter, Cancellation of trip 30 days from departure is charged a cancellation fee of 50% of total charter, Cancellation of trip less than 30 days from departure is charged a cancellation fee of 100% of total charter.

11e. If you attempt a chargeback because you did not qualify for a refund, please note our procedure. We will respond to such chargeback immediately. We then depending upon the dollar amount can/will file charges of credit card fraud with the County Sheriff (Please note that the dollar threshold in Florida is very low to become a felony). You can also be subject to civil penalties of up to 3 times the amount of booking or a minimum of $200.00, plus court cost and legal fees. We also may send your information to our associations and other transportation companies impeding your ability to get transfers in the future within the State of Florida. The Florida Sunshine Shuttle as well as other transportation companies have zero tolerance for credit card fraud and work together to combat it.

12. Reservations

Reservation Center Hours are open Mon – Sat 8:00AM until 06:00PM and Sunday 9AM until 12:00PM, Eastern Standard Time, Call 1-877-554-7020. Hours are subject to change at any time without notice.

13. Seating Assignments

Scheduled / Shared Shuttles
Advanced seat assignments are not available.

14. Smoking / Food and Drink

Smoking is not permitted on-board any vehicle. Food and drink is not permitted to be consumed or held on any vehicle unless otherwise noted.

15. Ticketing 

The Florida Sunshine Shuttle does not issue paper tickets. All passengers receive an e-mail confirmation at time of booking. All passengers will be required to show valid Photo Identification at time of boarding.

16. Trip Cancellations

Scheduled Service
If a scheduled service or shared shuttle trip needs to be canceled the Florida Sunshine Shuttle will make every reasonable attempt at alternate transportation for your party. On scheduled shuttles if trip cancellation were to occur you would be placed on the next available scheduled departure.

17. Trip Delays

The Florida Sunshine Shuttle makes every attempt to run on-time according to our schedules, however, traffic conditions, vehicle breakdowns and weather may alter our departure and arrival times. When this happens, we make every attempt to communicate with our passengers to keep them informed as to the cause of the delay and the estimated time of departure / arrival. We thank you in advance for your patience and understanding the unavoidable delays are beyond our control.

17a. Pick ups to the Port may be delayed if passengers are delayed getting off the ships. Our vehicles will wait at the Ports so that other passengers delayed may make their outbound flights. If at any time the Ports disembarkation is delayed passengers going to airports will take priority over those passengers going to a hotel, residence or those going to the port.

17b. Please understand that the Florida Sunshine Shuttle will not provide full or partial refunds due to delays that are not within our control.

18. Unaccompanied Minors 

Only passengers 16 years of age or older are permitted to travel without a parent or guardian (unaccompanied). Minors under the age of 16 are not permitted to travel unaccompanied for any reason.

Carriage is at the discretion of the Florida Sunshine Shuttle.

19. Child Seats

Child seats are a request and are not guaranteed. Use of the child seat is at your own risk and you release us from any and all liability for any injury whether directly or indirectly caused by us or any other agent assigned by us. If a child seat is requested and not received the only recourse offered will be a credit for the amount charged for the car seat as car seats even when paid are not a guarantee to be in the vehicle. Child seat fees have no effect on the transfer itself nor any price paid for such.

 20. Limitation Of Liability
Neither the company, nor the service provider, shall be liable in any event or for any reason, including breach of this agreement, either directly or indirectly, to the other party or any third party for any special, indirect, incidental, punitive, exemplary, or consequential damages or loss of profits arising out of this agreement, even if such damages. It is expressly agreed that neither the company nor the service provider shall under any circumstances be liable to any party for an amount greater than the single bus charter fee for the day in question.

20a. Release Of Liability
The Company, its employees, shareholders, subsidiaries, affiliates, officers, directors, successors, agents and assigns do not own or operate any equipment or Service Provider which provides, or is to provide, goods services for your trip, including, transportation companies. The Chartering Party (for itself and on behalf of the Passengers) hereby expressly agrees that The Company shall not be responsible in any manner for the acts or failures to act, negligently, willfully or otherwise, of the Service Provider or its employees, agents or representatives. The Chartering Party (for itself and on behalf of the Passengers) also expressly agrees that The Company shall not be liable for any bodily injury or harm, accidents, property damage or personal loss as a result of the Transportation Services provided under the Service Contract. To the fullest extent permitted by law, and notwithstanding any other provision of this Agreement, the Chartering Party and its passengers agree, in consideration for the services provided by The Company, to indemnify and hold The Company harmless from any and all damages, injuries, claims and causes of action, of any type or kind, whether or not caused in whole or in part by the negligence of The Company, its employees, agents or representatives or the Service Provider or its employees, agents or representatives. The Chartering Party (for itself and on behalf of the Passengers) hereby expressly agrees that if any portion of the Service Contract, including the terms of the Limitation of Liability paragraph or this paragraph, is found to be void or unenforceable, the remaining portions of this Service Contract shall remain in full force and effect.

20b. Force Majeure
The Company and the Service Provider shall not be liable for any failure or delay in performing their obligations under the Service Contract, and neither party shall be deemed in breach of its obligations there under, if such failure or delay is due to Acts of God, natural disasters, national, state or local states of emergency, acts of war or terrorism, labor strike or lock-out, or other industrial or transportation accident caused by any third party, any violation of law, regulation or ordinance by any third party or any other cause not within the control of The Company or the Service Provider, respectively.
